Beijing Service Center For Intellectual Property Protection, authorized for operation by the Municipal Organizational Affairs Commission and operated on the appropriated fund from the municipal government, is a division-level semi-governmental agency. The departments under the Center are General Affairs Office, Complaint Processing Department and Information Analysis Department. The Center's main functions are: receive and assign the city's IPR violation complaints, monitor the processing of complaints till their final solutions and give feedback on the processing to the complainants; provide IPR legal consultation service to right holders and the public; collect, compile and analyze the complaints received, assigned and resolved to provide data support for government decision-making.
Provide service to the Municipal Office of IPR Protection Working Group and form an integrated, inter-related, responsive and information-sharing IPR protection mechanism.
Scope of Complaints: 1. Infringement of trademark, 2. Infringement of copyright; 3. Infringement of patent, passing off other's patent and faking patent identity; 4. Misappropriation of trade secret; 5. Infringement of geographic indication; 6. Infringement of new variety of plant; 7. Infringement of layout design of integrated circuit; 8. Other types of IPR infringements.
Requirements for Bringing Case: 1. Confirmed complaint target; 2. Specific facts; 3. Belonged to the scope of complaints and the jurisdiction of the administrative agencies; 4. Complainant shall disclose the true information of his/her name and contact details. The complaints which do not disclose the required information but can prove the existence of the IPR violations are also accepted.
